壹、緣起
在傳統的刑事司法系統運作思維下，犯罪被害人權益的保障長期被忽略。2017 年 8 月在「總統府司法改革國是會議」分組決議第7項決議特別提出「司法系統對於犯罪被害人、弱勢群體的保護仍有不足，不論是法律程序的協助、相關資源的引進，都還有很大的改善空間。」此外，第8項決議則指出「對於收容少年的處遇、教育與輔導，現行制度仍有極大的改進空間，亦亟需相關資源的整合與投入。」鑒於警察是刑事司法系統的守門員，對於如何落實前2項決議扮演著舉足輕重的角色。尤其，在立法院二讀的「跟蹤騷擾防治法」草案，警察更扮演著最重要的角色。因此，本次行政警察學系研討會乃以「警察與犯罪被害人保護」為主題，進行相關議題之研討。
Under the traditional operation of criminal justice system, the protection of the rights and interests of criminal victims has long been ignored. In August 2017, the Presidential Office Judicial Reform Conference proposed that "the judicial system has insufficient protection for criminal victims and vulnerable groups. Whether it is the assistance of legal procedures and the introduction of related resources, there is much room for improvement." In addition, the meeting also pointed out that "the current system still has a lot of room for improvement in the treatment, education and counseling for illegal juveniles, and the integration and investment of relevant resources are urgently needed." Since the police are the goalkeepers of the criminal justice system, they play a pivotal role in how to implement the two resolutions. In particular, the police played the most important role in the draft of the "Tracking Harassment Prevention Law" in the Second Reading of the Legislative Yuan. Therefore, the symposium of the Department of Administrative Police is focused on the theme "Police and Crime Victim Protection".
